Chemical Spills in West Virginia

You may have heard about the chemical spill in Charleston WV, that has contaminated the drinking water of 300,000 people.  Some links to articles follow this posting; i have been sending around the following query but have not been able to come up with any answers, except the one I just heard on #4.
Please correct me if I am wrong on any of the following, because I do not want to be guilty of peddling misinformation in any of my postings to email, facebook, blogs, or letters to the editor.

(1)     Both Sen Manchin and Gov Tomblin have hastened to point out that the coal industry bears no responsibility for this chemical spill

(2)    Sen Manchin, Gov Tomblin, WV Attorney General Morrissey, WV DEP (any other entities?) have filed suit against EPA to prevent it from passing any regulations to protect the air, water, and land of West Virginia residents.

(3)    Major Democratic candidates for public office, including Natalie Tennant, U S Senate, Nick Casey and Meshea Poore, for Congressional District 2, Rep Nick Rahall of Congressional District 3, and Glen Gainer for Congressional District 1, vow to fight the Obama administration tooth and nail to prevent it, and its EPA or any other agency, from limiting the right of industry in WV to pollute air, water, and land.
(4)    Also, is information available as to how recently, and how frequently, DEP or relevant agency has inspected this, and other, chemical facilities in our state?  (Since writing this, I have heard, via Democracy Now, that the Freedom Industries site has not been monitored since 1991.)
(5)  How is it that this facility is able to be so close to the river and to the water treatment plant?  Who authorizes these sites?
(6)  And who is going to check on the inspections that DEP has ordered Freedom Industries to make on its o)n facility?
